By accessing or using Aquarium ("the Service"), including the Discord bot and web dashboard, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years old (or the minimum age required by Discord in your jurisdiction) to use this Service. By using the Service, you represent that you meet this age requirement.

2. Description of Service

Aquarium provides real-time translation services for Discord servers, enabling multilingual communication through:

• Automated message translation to multiple languages
• Language-specific immersion channels
• Usage tracking and gamification features
• Server management dashboard
• Moderation tools

3. User Accounts

3.1 Account Creation

To use certain features, you must authenticate through Discord OAuth2. You are responsible for maintaining the security of your Discord account and any actions taken through the Service using your credentials.

3.2 Account Responsibilities

You agree to:

• Provide accurate information during authentication
• Keep your account credentials secure
• Notify us immediately of any unauthorized use
• Not share or transfer your account access

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Violate Discord's Terms of Service or Community Guidelines
• Harass, abuse, or harm other users
• Send spam, unsolicited messages, or automated content
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or its systems
• Circumvent usage limits or subscription restrictions
• Interfere with or disrupt the Service's operation
• Scrape, data mine, or extract data from the Service without permission

5. Content Policies

You retain ownership of content you submit for translation. By using the Service, you grant us a limited license to process your content solely for providing translation services.

5.2 Prohibited Content

You may not translate or transmit content that:

• Contains illegal material
• Promotes violence, hatred, or discrimination
• Contains sexually explicit material involving minors
• Infringes on intellectual property rights
• Contains personal information of others without consent

6. Subscription and Payment

6.1 Free Tier

The Service offers a free tier with limited translation characters per month. Free tier usage is subject to fair use policies and may be restricted if abused.

6.2 Paid Subscriptions

Paid subscriptions provide increased usage limits and additional features. By subscribing, you agree to:

• Pay all fees associated with your subscription plan
• Automatic renewal unless cancelled before the renewal date
• Provide accurate billing information

6.3 Refunds

Refund requests are handled on a case-by-case basis. Generally, we do not provide refunds for partial billing periods or unused translation characters. Contact us if you believe you are entitled to a refund.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be:

• Temporarily unavailable for maintenance or updates
• Subject to outages beyond our control (Discord outages, cloud provider issues)
• Modified, suspended, or discontinued at any time

8. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Aquarium and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• Translations will be perfectly accurate or appropriate for all contexts
• The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUARIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Aquarium, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data in accordance with our Privacy Policy
• Provisions that should survive termination will remain in effect

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Aquarium operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
